Last Will and Testatment of John Stones of Mosborough (1745)

I John Stones of Mosbrough in the County of Derby and Parish of Eckington do make this my last Will and Testament in manner and form following and do declare this to be my last Will and Testament and every Will by me before made to become void and of no effect I do leave and bequeath to my mother my house at Mosbrough and all my Lands and Estate in the parish of Eckington to her during her natural life and after her decease I do leave my Estate in the parish of Eckington to my Brother Thomas Stones and his issue Male and for want of issue Male of the said Thomas Stones I do leave all my Estate in the parish of Eckington and Elsewhere to William Bagshaw of the Inner Temple Second Son of Richard Bagshawe of the Oakes to him and his heirs forever I do leave my Estate at Ousfleet in the County of York to my said Brother immediately after my death but subject to the same conditions of my other Estate viz. not in his power by any ways to Alienate or dispose of but to his issue Male and for want of issue Male to descend to the aforesaid William Bagshaw I do appoint William Bagshaw to be Executor of this my Will and for his trouble do leave him One Hundred pounds to be raised within one month after my death and also the best horse or mare I dye possessed of I also leave to my Sister Cruso two hundred pounds if she be living at the time of my death which said sum of three hundred pounds to be paid within a month after my death and also all my debte by a Mortgage upon any part of my lands in Derbyshire in case there should not be found money enough to disburse the above payments but all arrears of that or any other money I dye seize of is to answer that purpose I mean to pay my debts and that ….. ….. said sum of three hundred pounds in case my sister be living All my furniture and personal Estate I leave to my Mother for her use during her life but order an account to be taken of it by my Executor and she be oblig’d to make good all deficiencies at her death if my said Mother does not dwell six months in every year in my Mansion House at Mosborough She shall have no title or benefit from this my will I do declare this to be my last Will and Testament and wrote with my own hand In Witness whereof I do set my hand and seal this Eleventh day of October in the year of Our Lord One thousand Seven Hundred forty five
