This is the last Will and Testament of me William Cowley of Mosbro’ in the Parish of Eckington in the County of Derby late Scythe maker whereby I will and direct that all my just debts funeral and testamentary expenses be paid and discharged by my Executors hereinafter named I give and devise all that my copyhold close or parcel of land called the Syrup Close now in the possession of Luke Howcell(?) Sickle Maker situate near Mosbro’ aforesaid containing four acres two roods and twenty four perches or thereabouts with the appurtenances unto my daughter Maria Newport and her assigns for her life without impeachment of Haste and on her decease unto her son Edwin Newport his Heirs and assigns for ever And I give and devise all that my Messuage or Dwellinghouse Barn and Smithy wherein I now reside with the Garden and Croft lying near thereto with the appurtenances and also all that Messuage or Dwellinghouse in the occupation of George Oates situate at Mosbro’ aforesaid containing together three roods and six perches or thereabouts with the appurtenances And also all that copyhold close or Parcel of Land commonly called or known by the name of Latwellsick situate at or near Mosbro’ aforesaid containing two acres and sixteen perches or thereabouts with the appurtenances now in the possession of George Roberts Farmer unto my son William Cowley his heirs and assigns for ever subject to and charged as to both Freehold and Copyhold premises with the payment to Eliza Harrington who now resides with me of the sum of Twenty pounds I give and bequeath to the said Eliza Harrington the sum of Twenty Pounds I give and bequeath to the said Eliza Harrington the sum of Twenty Pounds to be paid within twelve months next after my decease I give and bequeath all the rest residue and remainder of my Real and Copyhold Estates of which I have power to dispose with their appurtenance and also all my personal Estate and Effects whatsoever and wheresoever unto my brother John Cowley and my friends Thomas Wilson late of Sheffield Dyer and now of Cherry Tree Hill near Sheffield in the County of York Gentleman and George Hudson of Mosbro’ aforesaid Sicklesmith their Heirs Executors Administrators and assigns respectively upon Trust with and out of the Rents and profits of my said Real and Copyhold Estates or by sale or Mortgage of the same or a competent part or parts to raise in aid of my personal Estate so much money as shall be requisite to satisfy my Funeral and Testamentary Expenses and Debts and the Expenses of executing the tenets of this my Will and to apply the money to be raised accordingly and subject thereto In Trust for my Son John Cowley his Heirs and Assigns for ever And I declare that the receipts of my said Trustees or the Survivors or Survivor of them his Heirs Executors and administrators shall exonerate Purchasers Morgagees and others paying Monies to such Trustees or Trustee from all liability in respect of the application thereof And also that every Sale and Mortgage and other charge shall in favour of the Purchaser Mortgagee or lender be presumed to be necessary And I do declare that my said Trustee shall be answerable for their own respective acts receipts and defaults only and shall be at liberty to retain and to allow to each other out of Monies coming to their hands by virtue of my Will all expenses incurred in executing the trusts thereof and I appoint my said Brother John Cowley and my said Friends Thomas Wilson and George Hudson Executors of this my Will hereby revoking all other Wills In Witness whereof I the said William Cowley the Testator have to this my last Will and Testament contained in this and the preceding sheet of paper set my hand that is to say my hand at the bottom of the preceding sheet and my hand at the foot or end of this my Will the twenty second day of September in the year of our Lord one thousand eight hundred and forty
