Last Will and Testament of William Bradshaw of Mosborough, maltster (1808)

This is the last Will and Testament of me William Bradshaw of Mosborough in the Parish of Eckington in the county of Derby, Maltster. Whereby I give devise and bequest unto my Brother Benjamin Bradshaw of Huddersfield in the West Riding of the county of York surgeon and my Friend William Mullins of Mosborough in the said Parish of Eckington Farmer their Heirs Executors Administrators and assigns, and whom I appoint Executors of this my Will All my freehold and copyhold estates lying and being in Mosbrough in the said Parish of Eckington (all which said copyhold Estate I have Surrendered to the use of my Will) and all other my Estate and Effects whatsoever and wheresoever of what nature kind or quality soever the same may be Upon the Trusts and to and for the Uses Intents and Purposes hereinafter declared of and concerning the same That is to say in the first place Upon Trust that they the said Benjamin Bradshaw and William Mullins and the survivor of them and the Executors Administrators and assigns of such survivor Do and shall pay all the just Debts which I shall owe at my decease together with my funeral expenses and the expenses of Proving this my Will. And in Order to enable my said Executors to make the said payments I will order and direct that they shall sell such of the Personal Estate as will not be useful for my mother and also such pieces or Parcels of land shall be sold by my said Trustees as they in their judgment shall think proper for defraying the remainder part of my just Debts. But if either of my said Trustees shall advance any money towards defraying the above said just debts they shall receive lawful interest for the same and in order to enable my Dear Mother to have a comfortable livelihood in case she shall survive me. Upon further Trust that they the said Benjamin Bradshaw and William Mullins and the survivor of them and the Heirs Executors Administrators and assigns of such Survivor, Do and shall let all such other lands as shall not have been sold together with the malthouse and all other the buildings and Gardens (except such as will be useful for my mother to live in) and the profits arising from such letting shall be paid to my Mother or my Sister Elizabeth Gilbert if she shall look after her or to such other Person as shall look after her and wait of her in such proportions as my said Trustees shall think most meet during her life. Then from and after the death of my said Mother the whole of my estate then left shall be let (except the Little House, Shop and Garden back of the Shop, which shall be kept for my two sisters Viz Elizabeth Gilbert and Mary Bradshaw or either of them Provided my sister Elizabeth shall not cohabit with her Husband or my sister Mary shall not marry. But if my sister Elizabeth should cohabit with her Husband and Mary should marry then the above said Little House, Shop and Garden shall be let and the profits arising from the above said letting or lettings shall be divided equally between my two sisters Elizabeth Gilbert and Mary Bradshaw yearly during their joint lives But when either of them shall happen to die then her share shall be given to my Nephew John Gilbert if he shall so long live but if her share be dead then the said share to be given to my Brother Benjamin Bradshaw or his Heirs during the life of the survivor of my said two sisters (but if either of my said two sisters shall claim any share under my Father’s Will then they shall have nothing under this my Will Then from and after the Death of my said Two sisters I give devise and bequeath to my Brother Benjamin Bradshaw his heirs and assigns forever all and every part and parcel of my real estate whether freehold or copyhold which have not been sold, subject nevertheless and charged and chargeable with the payment of One Hundred Pounds to my nephew John Gilbert and Thirty Pounds to my niece Mary Gilbert if they shall so long live. And the said John Gilbert to rent the whole of the place except as above excepted at a moderate rent if it should be his desire when he arrives at the age of twenty one years And for the facilitating of the sale of any part or parcel of my real estate I do hereby declare that the receipt of Benjamin Bradshaw and William Mullins or the survivor of them or the Heirs Executors Administrators of assigns of such survivor from time to time be a good and sufficient discharge to the Purchaser or Purchasers of any part of any real estate And his or their respective Heirs Executors Administrators for so much of such purchase money as shall be therein acknowledged to be received and such purchaser or purchasers his her or their respective Heirs Executors and Administrators or any of them shall not be afterwards answerable or accountable for any loss of such purchase money or any such thereof And I do hereby revoke all former and other Wills by me heretofore made In Witness whereof I the said William Bradshaw have to this my Will contained in the two sheets of paper, to the first sheet have wrote my name and to the second wrote my name and my seal the Twenty fifth Day of April in the year of our Lord One thousand Eight Hundred and Eight.
