Last Will and Testament of Thomas Westerne the older of Mosborough, yeoman (1657)

The Twelfth day of May in the yeare of our Lord god accordinge to the Computation of the Church of England one thousand vi hundred ffyfty and seaven I Thomas Westerne the older of Mosborough in the parish of Eckington in the county of Derby yeoman sicke in body but whole in minde and being of good and perfect remembrance and praise bee to god therefore And remembringe with my life the certainty of death and the uncertainetie of the day and houre of death doe devise constitute ordain and make this my last will and present testament in manner and forme ffollowinge ffirst and principally I bequeath my soule into the hands of Almighty god my maker ffully trusting by the death and passion of my Saviour and redeemer Jesus Christ to have free release and pardon of all my sinnes and after this life life everlasting and my body to bee buried in the parish Church of Eckington at the discretion of my friends And as for those wordly goods that god hath endued mee withal after my debts paid and my funeral expenses discharged I give and bequeath in manner and forme following ffirst I give and bequeath unto Alice Westerne my loving wife the summe of ten pounds of good and lawfull money of England o bee paid unto her within one whole yeare after my decease Also I give and bequeath unto Thomas Westerne my Sonne two pounds and ten shillings of good and lawfull money within one yeare after my decease Also I give and bequeath unto ffrancis Buntinge and Mary his wife either of them three shillings and foure pence of good and lawfull money of England to be paid unto them within one whole yeare after my decease Also I give and bequeath unto Sarah Buntinge daughter of ffrancis Bunting and Mary his said wife the summe of twenty shillings of good and lawful money of England to bee paid within one whole yeare after my decease Also I give and bequeath unto John Westerne my sonne one Dray horse which I bought of Jervas Poole Esquire and two paire of wain stathes which I last bought and are somewhat hewen Also I give more unto Thomas Westerne my sonne all the wheele tymber excepting that my sonne Thomas shall make for my sonne John Westerne one paire of sufficient waine wheeles att his own proper cost and deliver them to my sonne John without receiveing any moneys for them Also I give and bequeath unto Elizabeth Westerne wife of my sonne Thomas and unto Mary Westerne daughter of my sonne Thomas and Elizabeth either of them three shillings and four pence The residue of all my goods cattells and chattells whatsoever unbequeathed I wholely give and bequeath unto Alice Westerne my loving wife and John Westerne my sonne whom I make sole executrix and Executor of this my last will and testament Also I make Thomas Couper of Mosbrough in the aforesaid parish and county gentleman Supervisor of this my last will and Testament desireing him as I especially trust him to bee aiding and assisting of this my exectutrix and executor to see this my last will and testament performedAnd I give him for his paines ffive shillings and I revoke all former wills by mee heretofore maide In wittnes whereof I the said Thomas Westerne therefore have sett my hand and seale the day and yeare ffirst above written Before the sealeinge and delivery and before the executrid and executor was named I doe give and bequeath unto Edward Westerne my brother ffive pounds of good and lawfull money of England to bee paid within one whole yeare after my decease And further to bee maintained by my executrix and executor during his naturall life with sufficient meate drinke and fitt and decent apparel and other necessary accomodations provided all waies that if any manner of difference in future tyme shall arise betwixt the said Edward Westerne and the executors above named aboute maintenance or any other difference what soevr then my will and minde is that the same bee referred to the supervisor to determine and end the same and that provision bee made forth of my personall estate for his maintenance what hee in his judgement shall thinke ffitt In witness whereof I have sett to my hand and seale the day and yeare abovesaid
