Last Will and Testament of Thomas Newbold of Mosborough, yeoman (1612)

In the name of God Amen The thurtyth daye of March Ann Dm 1612 I Thomas Newboulth of Mosburgh in the Countie of Derby yeoman being sycke of bodie but in good and p’fecte remembrance (god be praysed) Doe ordayne and make this my laste will and Testament in manner and forme followinge First I Comend my soule to god on the Sufferinge and obedience of Christ my Saviour And my bodye to be buried in Beighton Churche ….. to the place where my father was interred Item I will and my mynde y’s The my debts funeralles and Legacies shalbe paied of my whole goodes ….. being deducted Then my mynde and will y’s That Elizabeth my wife shall have a thyrde p’te of my goodes and chattels And that Robte George Ellise and Rose my younger children shall have the other same p’tes of all my goods and chattels equally devyded amongst them Also where Herny Newbouuld dothe oweth me (£20?) I gyve the same debt unto Elizabeth his daughter And I will that myne Executrix shall suffer saied Elizabeth to receive yt of her father Butt my meaning ys not to charge myne Executrix with payment of anything to the saied Elizabeth Item my will and mynde ys that Elizabeth my wyfe shall during her widowhood have and enjoy all my Copiehoulde lande w’thin the manner of Eckington according to the custome of the saied mannor Item I gyve and bequeath unto Robte Newbould my sonne all that my messuage or Tenament sett lying and beinge in mosburgh aforesaied Together with all lande meadowes pasture arable lande houses buildings and ….. w’thall and singular theire appurtnenants w’ch I bought of one Thomas Staynerodd of Dronfeld in the saied County of Derby deceased To have and to houlde the saied messuage or tenement and all other the premises ….. saied appurtening unto the saide Robte Newboulde my sonne And the heires of his bodie lawfully begotten And for defalte of yssue of the bodie of the saied Robte Newould Then I desire and gyve the saed messuage and other the premises w’th aforesaied appurtenance to George Newbould my sonne And to the heires of the bodie of the saied George lawfully and for lack of yssue of the house of the saed George newbould Then I devise and gyve the saide messuage and or tenement and other premises with theire appurtenance unto Elllise Newould my sonne and to the heires of the bodie of the saide Ellise lawfully begotten And for lack of issue of the house of the saide Ellise Newbould lawfully begotten Then I will that the saied messuage or tenement and other the premises w’th theire appurtenances shall wholly remaine to my Right heires for ever Item my will and mynde ys That Robte Newbould my sonne or w’ch of my children shalle have of the said messuage or tenement and other the premises w’th saied appurtenances shall pemytt and Suffer Thomas Newbould my kinsman To have houlde and ….. enjoye all that p’rt of the saied messuage tenement …. ….. ….. in houldinge or occupation of the saied Thomas Newbould until my eldest sonne Robte or wh’ch of my Sonnes shallbe myne heire shall accomplish the full age of Twenty ….. (the following words are illegible owing to a crease in the parchment) of ten shillings yearly hee the said Thomas seizing and enjoying the same tenandable and in good Repayre Item I gyve and bequeath unto the saied Robte Newbould my sonne and aire …. those woodes or meaddowe and pasture sett lying and beinge witin the Lordshipp of Eckington and Territories of the same That is to …… one Acre of meaddowe lyinge in a Close called the Southemeddowe betweene the lande of William Kentt on the northe p’te and one meadowe called Abbott meadowe on the Southe p’te and one lande or ….. lying in a feelde called the gate feelde lying appon a furlong calle the maples between the lande of Robte Smyth on the east p’te and the lande of ….. ….. of the west p’rt And also one other lande of woode lyinge in a feilde called the myddell feilde uppon a furlong called the ….. betweene the lande of John Treeton on the east and the lande of Henry Crofte west to have and to hould the said Acre and ….. ….. of lande unto the saied Robte Newbould my Sonne and to the heires of his bodie lawfully begotten for ever Item I doe devise and gyve unto George Newbould my Sonne One Dwellinge house and garden and yearde and Close contayninge by estimation one acre and an halfe lyinge and beinge at Mosburghe greene and adjoyninge to Mosburghe feelde in the houldinge of one Godfey Smythe To have and to hould the saied house garden and yearde and other the premises with appurtenances unto the saied George Newbould my Sonne and to his heires for ever Item I devise gyve and bequeath unto the saied George Newbould my Sonne that foure acres of customarie or copyiehould land w’ch I bought of Robte Sytwell sett lying and beinge in Eckington or within the territories of the same excepte certten lande w’ch I soulde to George Sytwell out of the same To have and to houlde the same copiehould lande unto the said George Newbould my Sonne and his heires for ever Item I devise gyve and bequeath unto Ellis Newbould my Sonne towe Closses or parcells of Lande meadowe or pasture sett lying and beinge in the feeldes of Sheffield or territories of the same Contayning foure acres be yt more or lesse w’ch I lately boughte of Thomas Braye and Johanne Braye To have and to houlde the same premises with their appurtenances unto the saied Ellis Newbould and to his heires for ever All the rest of my landes not gyen nor bequeathed I wholly gyve and bequeath unto Thomas Newbould my eldest Sonne and his heires for ever Item I gyve and bequeth unto Thomas Newbould my eldest Sonne fourtie shillings in full ……. of his chyldes part and filiall portion of all my goodes and chattells Item I give unto John Newbould my Sonnne ….. fourtie shillings in full …… of his childes part and filiall portion of all my goodes and chattells Item I give unto Rose Newbould my daughter as a legacie ten pounde in money my best gown and my best brasse pott Item I give unto my brother Robte Newould my best Clocke Item I give and bequeath unto Rychard Newbould my kinsman xxs Item I give and bequeath unto my Cozen Anne more £5 Item I Constitute ordeyn and make Elizabeth my wife the Sole Executrix of this my last will and testament and I give her £10 as a legacie and my mynde and full pleasure ys that Elizabeth my wife shall have the interest and government of all my children duringe their Severall mynorities and that shee shall have the disposing of theire respective landes and goodes until they shall respectively attain to the age of twentie and one yeares of age Item I desire my brother Ellis younge and Edward hobson to be Supervisors of this my last will and Testament to see it executed according to the intent meaning and I give either of them for their paines taking herein iis In Wytness whereof I the said Thomas Newbould unto this my last will have subscribed my marke and putte my Seale
