Last Will and Testament of Robert Higgenbotham the Elder of Mosbrough, yeoman (1707)

In the name of God Amen I Robert Higgenbotham The Elder of Mosbrough in the pash of Eckington in The County of Derby yeoman beinge weake and infirme in body but of sound and pfect minde and memory (praise be given to Almighty God for the same) Therefore considering The frailty and incertainty of this humane life doe make and ordaine this my Last Will and Testament in manner and forme following First and principally I comend my Soule into the hands of Almighty God my Creator hopeing assuredly through the merritts and mediation of the death and passion of Jesus Christ my only Saviour and Redeemer to obtaine pardon and remission of my Sins And my body I comitt to the Earth from whence it came to be decently buryed att the discretion of my friends And as for my Temporall and worldly Estate wherewith it hath pleased God of his goodness to bless me I give and dispose thereof as followeth First my Will and minde is and I doe hereby order that Easter my loveinge Wife shall have hold and possesse and enjoy all my Lands and personal Estate (after my Funerall charges are paid out of the same) and shall take and receive the rents and profits thereof to her owne use for and during the terme of her naturall life And from and after her decease my Will and minde is And I doe hereby give and bequeath unto my Sonne Jonathan Higgenbotham the lands lyinge and beinge in a field in Mosbrough aforesd called the Street Fields lyinge and beinge between the land of Thomas Stones Gent on the North and the land of Thomas Newbolt on the South with all and singular thappurtenances whatsoever to the same belonging to have and to hold the sd lands with thappurtenances unto my sd Sonne Jonathan Higgenbotham and his heires for ever Also I doe hereby give and bequeath unto my Sonne Robert Higgenbotham forty Shillings to be given to him by my Executor within Six moneths next after the decease of the longer liver of me and my sd Wife Also I doe hereby give and bequeath unto my Sonne William Higgenbotham children thirty Shillinges to be equally divided amongst them and my Will and minde is that the same be pyd them by my Executor within Six moneths next after the decease of the longer liver of me and my sd Wife All the rest residue and remainder of my personall estate after my debts legacies and funerall expenses are discharged I doe hereby give and bequeath unto my Sonne Joseph Higgenbotham And doe hereby make and ordaine him the sd Joseph sole Executor of this my last Will and Testament And I doe hereby revoake make null and voyde all former and other Will and Wills by me heretofore made and doe publish and declare this only to be my last Will and Testament In Witnesse whereof I have hereunto sett my hand and Seale the Eighteenth day of July in the Sixeth yeare of The Raigne of our Soveraigne Lady Anne by the Grace of God Queene over Great Brittaine &c. Anno Dm 1707
