Last Will and Testament of Nicholas Pedley of Plumley (1757)

In the Name of God amen on ye 28th day of March 1757 I Nicholas Pedley of Plumley in the parish of Eckington in the County of Derby being of sound memory and understanding am desirous whilst I am so of making my last will and Testament as follows. I give and bequeath unto my loving wife Martha Pedley all my Lands, goods, Tenements and Hereditaments until my son John attains to ye full age of Twenty one years, excepting the Whittington Lands which I leave to my son John immediately after my Decease with the Rents and Profits thereof. And when my son John comes to the age of twenty one years my will is that he shall enter upon the Farm of Plumley and that my wife Martha Pedley shall assign over to him all the personal estate Goods and Chattels whatever she shall then be in Possession of and during the time my said wife Remains a widow and unmarried I give her the Lands and Tenements at Whittington in the County of Derby in Consideration of her assigning over all the Personal Estate and Farm or Farms which she shall then be in Possession of when my son Comes at age and at her Death – to go to my son John his Executors Administrators or assigns. I mean expressly that my son John shall have the estate at Whittington till he arrive at ye age of Twenty one years and then to go to my wife for her life and unmarr’d along with the estate at Braddow (Bradway) abovementioned These two estates I desire she should enjoy so long as she Continues unmarr’d and at her Decease or another marriage to go to my son Also if my son Dies before he attains the age of Twenty one years I give and bequeath to Ann Steel of Staveley Fifty Pounds To Mary Frith of Duckmanton Fifty Pounds and also I give Fifty Pounds to and amongst Henry Normans Children in ye parish of Staveley to be equally Divided amongst them Also I give Fifty Pounds to Sarah Huttons Children to be equally divided amongst them. I give to John Booth the son of Henry Hutton one Hundred Pounds But in this case he is not to take any share of the fifty pounds which I have given to his Brothers and Sisters; and if Mary Frith Die before my son comes to ye age of Twenty one years I give her share to and amongst her sons to be equally divided between them All these Legacys I would have paid to every respective Claimant at the end of one year from the Death of my son John The Rest and Residue of my estate Real and Personal I give to my Loving wife Constituting and appointing her whole and Sole Executrix of this my last will and Testament hereby Revoking all former wills by me made in witness whereof I have set my Hand and seal on the 28th day of March in the year of our Lord 1757
