Last Will and Testament of Mary Rose of Mosborough, widow (1897)

This is the last Will and Testament of me Mary Rose of South Street Mosborough in the parish of Eckington in the County of Derby widow I appoint my son Walter William Rose and John Large the younger of South Street Mosborough Miner to be the Trustees and Executors of my will and who are hereinafter referred to as my Trustees and I bequeath to each of them my Trustees the sum of five pounds free of duty as some shall remuneration for the time and trouble they may take and have in executing the trusts of this my will I give and bequeath all my household goods and furniture and other household effects to my daughter Clara Agnes Rose subject and charged with the payment of the sum of twenty five pounds to my trustees within twelve months from my death to be held by them my Trustees In Trust for my daughter Louisa Jane Rose as hereinafter mentioned out of any moneys standing to my credit at  any Bank at my decease I give the following legacies namely To my grand – daughter Clara Agnes the daughter of the said Walter William Rose ten pounds to my said daughter Clara Agnes Rose ten pounds to my trustees In trust for my said daughter Louisa Jane Rose as hereinafter mentioned the sum of ten pounds and the balance of all such money as aforesaid standing to my credit I give to my said son Walter William Rose I give and devise all my real estate whatsoever and wheresoever ( including my property in School Lane and Station Road Mosborough aforesaid , and the residue of my personal estate whatsoever to my Trustees Upon Trust to sell and convert the same into money as soon as conveniently may be after my decease and after payment of such sale expenses as may be incurred in so doing I direct my trustees thereout and out of my ready money to pay my just debts funeral and testamentary expenses and subject thereto I direct my Trustees to pay thereout the aforesaid legacies to my trustees and also the legacy of twenty five pounds to my said son Walter William Rose and then to stand possessed of the residue of the moneys then remaining in the hands in Cash to pay and divide the same as to one third part thereof to my son Walter William Rose absolutely as to one other third part to my said  daughter Clara Agnes Rose absolutely and as to the remaining one third part thereof to retain the same In trust for my said daughter Louisa Jane Rose as next mentioned and I direct my trustees to retain all the moneys or bequests or gifts which shall come to their hands under this my will as hereinbefore directed in trust for my said daughter Louisa Jane Rose upon the following trusts namely In trust at the absolute discretion of my Trustees to invest the same as by law allowed to Trustees  and to pay or apply the income resulting from such investments in or towards the maintenance of my said daughter Louisa Jane Rose or her advancement in the world in any way whatever as my trustees in their absolute discretion may think fit without being liable to see the application of such income and such investments to be continued and such payment or application to be made during such time as my said daughter shall be confined to an Asylum or shall in the opinion of my trustee be of unsound mind whether so found by inquisition or not and if in the opinion of my trustees the said Louisa Jane Rose shall again become of sound mind after my death or shall be so at the time of my decease then I direct all such money bequests or gifts as aforesaid held in trust for her to be paid over to the said Louisa Jane Rose whose receipt shall be good discharge to my trustees for the same accordingly But in case Louisa Jane Rose shall die before the payment to her of the said monies gifts or bequests being then of unsound mind , then I give and bequeath the same and all moneys so held in trust as aforesaid to the said Walter William Rose and Clara Agnes Rose in equal shares absolutely In witness whereof I the said Mary Rose the testatrix have hereunto set my hand this sixth day of March 1897 .
