Last Will and Testament of John Riley of Mosborough Moor, sickle manufacturer and farmer (1869)

This is the last Will and Testament of me John Riley of Mosbrough Moor in the parish of Eckington in the County of Derby Sickle Manufacturer and Farmer I bequeath unto my eldest Son Charles Riley my Trade Mark ” IR ” for his absolute use and benefit I devise all the real estate to which I shall be entitled at my decease  (except estates vested in me as Trustee or Mortgagee), and I bequeath the residue of my personal estate to which I shall be then entitled to my Sons John Riley and Francis Riley their heirs executors administrators and assigns respectively upon trust to sell my real estate together or in parcels by public auction or private contract and to convert and get in my residuary personal estate and to stand possessed of the monies to arise from such real estate and residuary personal estate In trust after payment thereout in the first place of the costs and expenses attending the execution of the trusts of this my Will and all my just debts funeral and testamentary expenses for my four children the said Charles Riley John Riley Francis Riley and Selina the Wife of Elias Havenhand to be divided equally among them their respective executors administrators and assigns and the respective shares of such children to be absolutely vested at my decease I devise all real estate (if any) vested in me as Trustee or Mortgagee to the said John Riley and Francis Riley subject to the equities affecting the same respectively And I exempt every Trustee of my Will from liability for losses occurring without his own wilful default and authorize him to retain, and allow to his co – trustee all expenses incidental to the trusteeship I appoint my said sons John Riley and Francis Riley to be Executors of my Will Lastly I revoke all other Wills In witness whereof I have hereunder set my hand this thirtieth day of June in the year of our Lord one thousand eight hundred and sixty nine – – Signed by the said Testator as his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witnesses – Alfred Alderson – Christr. This is a Codicil to the last Will and Testament of me John Riley of Mosbrough Moor in the parish of Eckington in the County of Derby Sickle Manufacturer and Farmer which Will bears date the thirtieth day of June in the year of our Lord one thousand eight hundred and sixty nine I bequeath unto Elizabeth the wife of John Riley of Mosbrough Moor aforesaid Sickle maker the sum of twenty pounds and I direct the same Legacy to be paid within twelve calendar months from my decease into her proper hands in order that the same may be enjoyed and disposed of as her separate property free from marital control and for which legacy her receipt shall be a sufficient discharge and I hereby direct that in case any person benificially interested under my said Will shall at my decease be indebted to me he or she shall not participate in my estate without bringing such debt into hotchpot, and I hereby confirm my said Will in all other respects In witness whereof I have hereunder set my hand this twenty fifth day of October in the year of our Lord one thousand eight hundred and Seventy three –  John Riley – Signed by the said Testator as and for a Codicil to his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as Witnesess – Jno.
