Last Will and Testament of John Pedley of Plumley, gentleman (1809)

This is the last Will and Testament of me John Pedley of Plumley in the parish of Eckington in the County of Derby Gentleman whereby I will and direct that all my just debts the expenses of my funeral the charges of carrying into effect this my Will and also of the erecting a tombstone or monument over my remains in the parish church yard of Eckington aforesaid which shall be at the expense of about fifty pounds be paid and discharged by my …….. and executors hereinafter named as soon as conveniently may be after my decease by and out of my personal estate and effects Also I give and devise all that Messuage Tenement or Dwellinghouse with the appurtenances situate at Eckington aforesaid as the same is in the tenure of James Booker unto my present housekeeper Peggy Harwood her heirs and assigns for ever in case she remain unmarried but not otherwise and in case of her marriage I give and the same from henceforth to John Harwood born on the body of the said Peggy Harwood his heirs and assigns for ever Also I give and devise unto the said John Harwood his heirs and assigns for ever all that Messuage Tenement Dwelling House and premises therewith I now reside situate at Plumley aforesaid together with all my freehold and copyhold lands thereto belonging containing by estimation one hundred and thirteen acres more or less situate at Plumley aforesaid as the same in now in my occupation Also all those three closes of land situate at High Bramley in the parish of Eckington aforesaid ……. by the Drain of the Bramley Brook containing about eight acres more or less Also all that close piece or parcel of land situate at Killamarsh in the County of Derby aforesaid called Salterford Meadow containing by estimations about Six Acres more or less Also a close of land called the Bents situate near Killamarsh Toll Bar and in the parish of Eckington aforesaid containing about four Acres more or less all which said Messuage Tenement Lands Hereditaments and premises are now in my own occupation also all those two Tenements or Dwellinghouses and several closes of Land containing about Eight Acres more or less situate at Whittington in the said County of Derby as the same are now in the occupation of William Taylor Also a Smithy and an outbuilding situate at Whittington aforesaid as the same are now in the occupation of John Thorpe and also all that Barn Stable and piece of land called the Croft containing about one Acre more or less situate at Eckington aforesaid as the same are now in the possession of Ralph Hodgkinson all which messuages Tenements Lands Hereditaments and premises mentioned to be situate at Plumley Lands at High Bramley the Meadow at Killamarsh the Close of Land called the Bents the Dwellinghouse Smithy and Lands Tenements Hereditaments and premises in the several occupations of myself the said William Taylor John Thorpe and Ralph Hodgkinson together with all houses outhouses Buildings premises and appurtenances thereto belonging or appertaining part whereof is freehold and other part thereof Copyhold and all such Copyhold Estate I have duly surrendered to the use of my last Will and Testament and all other my Messuages Tenements Lands Hereditaments and Real Estate whatsoever and wheresoever not by me hereinbefore nor hereafter disposed of To hold to the said John Harwood his heirs and assigns for ever Subject to and charged and chargeable with the payment of an Annuity or yearly sum of thirty pounds of lawful English Money to be paid to be issuing out of the same Real Estate hereby devised to the said John Harwood in….. payable to the said Peggy Harwood and her assigns for and during the term of her natural life and for so long thereof as she shall continue unmarried by half yearly payments the first payment whereof to be made to her at the End of Six Months after my decease Also I give and bequeath all the household furniture household Goods Beds Bedding Linen Plate China and of every other description whatsoever of household stuff which shall be in or about my Dwelling house on my decease together with all horses Cows Sheep and Cattle Corn Hay Straw Corn growing Goods and Chattels which I shall die possessed of on my decease Monies and Sureties for Money excepted Also I give an devise unto William Harwood born on the body of the said Peggy Harwood and to his heirs and assigns for ever all and every my Messuages Tenements Lands Hereditaments and premises situate at Mosbrough in the parish of Eckington aforesaid that is to say a Barn and several pieces of land called the Bunting Closes containing by estimation Eight Acres more or less as the same is now in the occupation of James Cowley Also a dwellinghouse outbuildings and several closes of Land containing together by estimation Six Acres more or less as the same are now in the occupation of William Tickhill Also a Dwellinghouse and Garden as the same is now in the occupation of William Swift their or some of their undertenants or Assigns and also all those two Messuages Tenements or Dwellinghouses with a Smithy thereto belonging lately erected and built and now unoccupied together with all and singular the appurtenances to the same Estate and premises devised to the said William Harwood belonging or in any wise appertaining To hold the said Messuages Lands Tenements Hereditaments and premises to the said William Harwood his heirs and assigns for Ever as the same are devised to him as aforesaid as to all the Residue and Remainder of my personal Estate and Effects of what nature or kind soever and wheresoever I give and bequeath the same unto the said Peggy Harwood and to my friends Benjamin Treeton of Sheffield in the County of York Butcher and George Woolhouse of Sheffield aforesaid Grocer and the Survivors and Survivor of them and the Executors and Administrators of such Survivor upon the trusts hereinafter mentioned (that is to say) upon trust that they my said Trustees or the Survivors or Survivor of them or their Executors or Administrators of such Survivor do and shall as soon as conveniently may be after my decease collect in and convert into money all my personal Estate and Effects not hereinbefore disposed of and call in all such Sum and Sums of Money as may be owing to me at the time of my decease and apply the same as hereinafter mentioned (that is to say) after such payments as are hereinbefore directed to be made by my said Executrix and Executors and the Charges of carrying into Execution the Trusts in my said Will contained pay and apply to the said William Harwood the Sum of five hundred pounds on his attaining the age of twenty one years and also do and shall place out at interest upon Real or Government Security the Sum of Eight hundred pounds and pay and apply the Interest Dividends and produce thereof for the maintenance and education of Ann Harwood born on the body of the said Peggy Harwood until she attains the age twenty one years and upon her attaining that age upon trust to pay assign or transfer to the said Ann Harwood the said sum of Eight hundred pounds and also that they my said Trustees or some or one of them do pay to George Ashmore and William Swift of Mosborough aforesaid labourers the Sum of ten pounds to each of them as shall be in my Employ on my decease Also in trust to pay to each and every poor widow within the Township and Quarter of Mosborough aforesaid the sum of one Shilling and such other poor persons within the said district the Sum of Six pence both at the discretion of my said Trustees And also provide for such of my Domestic Servants as shall be living with me on my decease a suit of Mourning Also to pay unto Sarah the Daughter of the late William Rotherham of Eckington aforesaid deceased now the Wife of Jarvis Haslehurst the Sum of one hundred pounds to be paid to her for her own separate use and benefit without the same being subject to the Control of her husband Also to pay to Harriott Rotherham the Daughter of the said William Rotherham the sum of One Hundred pounds and also that oath of them the said Benjamin Treeton and George Woolhouse as shall take upon themselves the Execution of the Trusts in my Will contained shall and may retain the sum of fifty pounds each as a compensation for their and each of their trouble in carrying the same into Execution And in trust to pay to my three Godsons the Sons of Thomas Slagg of the Ford in the parish of Eckington aforesaid Sickle Manufacturer the son of the said George Woolhouse and the son of Ezra Hutton late of Ridgeway deceased Sickle Manufacturer the sum of fifty pounds each and also to my Relation John Fitch late of Duckmanton farmer the sum of fifty pound and as to the Surplus of my personal Estate as shall be and remain after the payments hereinbefore directed to be made together with all Interest arising therefrom in trust to pay the same unto the said John Harwood his Executors and Administrators provided nevertheless And I do hereby will order and direct that in case of the death of the said William Harwood before he attains the age of twenty one years having lawful issue that the Messuages Lands Tenements Hereditaments and premises hereinbefore devised to him in fee simple shall and every part thereof shall be to and for such Child or Issue his heirs and assigns for ever But if the said William Harwood shall depart this life without having lawful issue and before he attains the Age of twenty one years then I direct that all and singular the said Messuages Lands Tenements Hereditaments and premises so devised to him as aforesaid shall be to and for the use of the said John Harwood his heirs and assigns for Ever And lastly I do hereby nominate constitute and appoint the said Peggy Harwood Benjamin Treeton and George Woolhouse Executrix and Executors of this my last Will and Testament hereby revoking all former and other Wills by me heretofore made In Witness whereof I have to this my last Will and Testament contained in four sheets of paper Subscribed my name and have set my hand and Seal to the last Sheet the Day and year first written.
