Last Will and Testament of John Galley of Mosborough, Farmer (1816)

The last Will and Testament of me John Galley of Mosbrough in the Parish of Eckington in the county of Derby Farmer First my Will and mind is that all my just debts Funeral expenses and the expenses of proving this my Will be paid by my Executors in Trust hereafter named out of my Personal Estate and Effects Then I give and devise unto my Son Charles Galley the Piece of Freehold Land lying and being in the Cliff(?) to him his Heirs and assigns for ever Also I give him one large Silver Spoon marked IJH Also I give and devise unto my daughter Charlotte Galley her own Mother’s box and all her Mothers Chattles together with half a dozen of Silver Tea Spoons and one pair of silver sugar tongues marked AF which was her Mothers and her mother’s Wheel. I also give and devise unto my sons William George and John each one large Silver spoon. Namely to William one marked JJH John’s marked IJE and George the other. Also I give to my Daughter Martha the two Silver spoons which are smaller and some bits of old silver which I wish to be arranged for a new spoon or spoons. I also give unto my Wife Sarah Galley the small quantity of Gold in the House (If my Trustees hereafter named think it right to give up the Farm.) Then I give and devise to my Wife Sarah Galley two beds with the Bedding and everything thereunto belonging and Also Furniture to furnish two rooms. All the rest residue and remainder of my Estate and Effects whatsoever and wheresoever and of what kind or nature soever the same may be I give and devise to my brother in law John French of Mosbrough aforesaid Gentleman, Joseph Rose of Mosborough Moor Auctioneer and Geoge Thompson of Mosbrough afores’d  School-master and the survivor of them. In Special Trust that they shall have a proper value taken of all my Personal estate and effects which shall be then left at the next Lady Day after my decease and the value of everything drawn up into one Sum. Then they my said Trustees shall reserve one fifth part for my said Son Charles Galley and also one fourth part for my daughter Charlotte Galley which shall be paid them when they shall arrive at several ages of Twenty one years. All the rest paid out for my said Wife and her Children as my said Trustees shall think proper But if my said wife shall desire to keep the Farm in possession She giving my said Trustees a good security for the whole of the property which shall be left in her possession which shall be paid and laid out as above directed. But if my said son Charles Galley shall happen to die without Lawful Issue Then I give and devise the whole of his share to my daughter Charlotte Galley her Heirs and assigns for ever or if Charlotte should happen to die not leaving lawful issue then I give her share to Charles. But if both my said Children should happen to die and not leaving lawful issue Then in that case I give and devise to my said son William Galley the piece of Freehold land above named to him/his Heirs and assigns for ever. And also I give and devise the money above devised to Charles and Charlotte in case of both their deaths to my three Children Namely George, John and Martha share and share alike. And I do hereby nominate my three friends John French, Joseph Rose and George Thompson above said Sole Executors in Trust of this my last Will and Testament hereby revoking all other and former Wills heretofore by me made In Witness whereof I have set my hand and seal the first day of May one Thousand eight Hundred and sixteen
