Last Will and Testament of John Cowley of Mosborough, sicklesmith (1800)

This is the Last Will and Testament of me John Cowley of Mosbro’ in the County of Derby Sicklesmith First I will that all my just Debts Funeral Expenses and the charges of proving this my will be paid and discharged by my Executor hereinafter named I give and devise to Samuel Cowley of Mosbro’ aforesaid Sicklesmith and John Cowley of Killamarsh in the said County of Derby Sicklesmith All that Close or parcel of Land called the Syrup Close containing three acres or thereabouts now in the occupation of James Cowley To have and to hold the said close of land (subject nevertheless and charged and chargeable with the yearly rent of four pounds hereinafter mentioned and with the payment of Twenty pounds hereinafter mentioned unto the said Samuel Cowley and John Cowley their heirs and Assigns for ever as Tenants in Common and not as joint tenants Also I give and devise to James Cowley of Mosbro’ aforesaid Farmer all that Close or parcel of land Called the Streetfield Land containin one Acre and a half or thereabouts and now in my own possession To have and To hold the same Close of land unto the said James Cowley his Heirs and Assigns for ever (subject and chargeable with the Annuity or yearly rent charge of two pounds and ten shillings hereinafter mentioned and with the payment of fifteen pounds hereinafter mentioned) Also I give and devise to Amos Cowley of Mosbro’ aforesaid Sicklesmith All that Messuage Tenement or Dwelling house with the appurtenances thereto belonging and All those several pieces or parcels of land following that is to say the Greater Syrup Close the Leser Syrup Close the Short Buts the Howbruck Close and the Croft containing together seven acres or thereabouts situate in and near Mosbro’ aforesaid and now in my own possession and of William Cowley and James Cowley To have and To hold unto the said Amos Cowley his Heirs and Assigns forever (subject and charged and chargeable with the Annuity or yearly rent charge of three pounds and ten shillings hereinafter mentioned and with the payment of ten pounds hereinafter mentioned) And I do hereby Give and bequeath unto Mary Cowley the Widow of my Brother James Cowley or her Assigns for and during her natural life (if she keep herself single and unmarried) the several Annuittyes or yearly rents or sums of Four pounds two pounds and ten shillings and three pounds and ten shillings amounting in the whole to the sum of ten pounds of Lawfull Money of Great Britan free and clear of Taxes and all other Deductions parliamentary or otherwise to be issuable and payable out of all and every the said lands and Premises hereinbefore Given to the said Samuel Cowley and John Cowley and James Cowley and Amos Cowley in the proportions following (viz) four pounds out of the land devised to Samuel Cowley and John Cowley two pounds and ten shillings  out of the land devised to James Cowley and three pounds and ten shillings out of the land devised to Amos Cowley and to be paid and payable at the place of her Habitation by equal half yearly payments at the two most usual Feasts or Days of payments in the year that is to say on the twenty fifth day of March and the twenty ninth day of September in every year the first payment to be made on such of the said days as shall first and next happen after my decease and my will is that in case the said three Annuities yearly Rents or sums or any of them or any part thereof respectively shall be behind and unpaid for the space of Thirty days next over or after either of the said Feasts or days of payment whereon the same are hereinbefore directed to be respectively paid as aforesaid then and so often it shall and may be lawfull for the said Mary Cowley or her Assigns to enter upon the land and Premises in arrear and unpaid and distrain for the Annuity or Annuities due or any part or parts thereof and all cost and charges occasioned by Nonpayment of the said Annuity or Annuities or any of them and of such Distress Also I give and bequeath to William Cowley of Mosbro’ aforesaid Scythemaker his Heirs or Assigns the several sums of twenty pounds fifteen pounds and ten pounds amounting in the whole to forty five pounds of Lawful Money of Great Britan payable out of all and every the said lands and Premises herein before given to the said Samuel Cowley and John Cowley and James Cowley and Amos Cowley in the proportions following (Viz) John Cowley and Amos Cowley the sum of ten pounds each at twelve months after my decease and Samuel Cowley the sum of ten pounds at twelve months after the decease of the aforesaid Mary Cowley and James Cowley the sum of fifteen pounds at twelve months after the decease of the above said Mary Cowley and James Cowley but if in case the aforesaid William Cowley should happen to die before me or the aforesaid Mary Cowley then my will and mind is that the said sums of money so given go amongst the Children of the said William Cowley as shall be living and attain the age of twenty one years when and as they severally attain the said age. Share and share alike. Also I give and bequeath unto John Morton the Elder of Rigway the sum of one shilling a week during his natural life to be paid by my Executor hereinafter Names Also I give devise and bequeath to the said Amos Cowley and Samuel Cowley their Heirs and Assigns as Tenants in Common and not as Joint Tenants All that pew or seat in the parish Church of Eckington aforesaid in the East Gallery thereof marked Number nine and Eleven I give and bequeath to Joseph Hobson of Mosbro’ Farmer and George Mullins of the same place Farmer the sum of one hundred pounds to be paid to them by my said Executor immediately after my decease Nevertheless upon Trust and for the purposes following (that is to say) upon Trust that they my said Trustees their Executors or Administrators or the survivor of them or the Executors or Administrators of such survivor do and shall place the same sum of one Hundred pounds out at Interest upon Government or other good and sufficient security in their own names and in such manner as they shall think proper and do pay and apply the Interest arising therefrom yearly and every year (in manner following) that is to say the Interest of Thirty pounds part of the said one hundred pounds unto John Morten of Ridgway Sicklesmith for and during his natural life the Interest of Thirty Pounds other part of the said one hundred pounds unto James Heppinstall of Wolden stubs for and during the Term of his natural life the Interest of Twenty Pounds of another part of the said one hundred pounds unto Elizabeth Latham wife of Jarvis Latham of Balm for and during her natural life and the Interest of Twenty Pounds the Remainder of the said one hundred pounds unto Mary Hodson wife of John Hodson of Whittington for and during her natural life And also upon this further Trust that they my said Trustees their Executors or Administrators or the survivor of them or the Executors or Administrators of such survivor do and shall dispose of the sum of one hundred pounds upon the events following in manner mentioned (Viz) on the Death of the said John Morton to pay the sum of Thirty Pounds unto and amongst the Children of the said John Morton as shall be living and attain the edge of Twenty on years when and as they severaly attain the said Age share and share alike On the Death of the said James Heppenstall to pay the sum of Thirty Pounds unto and amongst the Children of the said James Heppenstall as shall be living and attain the Age of Twenty one years when and as they severaly attain the said Age share and share alike on the Death of the said Elizabeth Lathham as shall be living and attain the Age of Twenty one years when and as they severally attain the said Age share and share alike On the Death of the said Mary Hodson to pay the sum of Twenty Pounds unto and amongst the Children of the said Mary Hodson as shall be living and attain the age of Twenty one years when and as they severaly attain the said Age share and share alike Lastly I give and bequeath to the said Amos Cowley all and every my Household Furniture Goods Stock in Trade Husbandry Utensils and all and every the Residue and Remainder of my Estate and effects whatsoever which I am or may be possessed of at the Time of my decease or entitled unto And I do hereby constitute and appoint the said Amos Cowley sole Executor of this my Will hereby revoking and making void all other and former Wills by me at any Time heretofore made and do declare this onely to be my Last Will and Testament In Witness whereof I the said John Cowley the Testator to This my will contained in two sheets of paper to first of which I have set my Hand and to the last sheet thereof my Hand and Seal this seventh day of August in the year of our Lord One Thousand Eight Hundred
