Last Will and Testament of James Peat of Mosborough, tailor (1868)

 This is the last Will and Testament of me James Peat of Mosborough in the parish of Eckington in the County of Derby Tailor I devise that messuage or Dwelling house now used as a Beerhouse under the sign of the Brown Cow with the dwelling house adjoining together with the Stable Garden and all other premises now used or occupied with the same with their respective appurtenances, situate and being at Mosborough aforesaid and now respectively occupied by George Plant and Luke Bennett, unto my Son James Peat absolutely but charged with the payment to my Executors at the end of twelve calendar months after my decease of the sum of One hundred and fifty pounds to be disposed of as part of my personal Estate hereinafter bequeathed I devise one half of the top Orchard at the North End thereof comprising fifty yards in length and eighteen yards in breadth together with a right of road for a Wheelbarrow and persons on foot to the said half of the top Orchard on the South side of the remaining part of the said & Orchard and across the yard hereinafter devised to my daughter  Susannah Galley and now in the respective occupations of my daughters Sarah Rivington , Susannah Galley myself and Mrs Poole unto my daughter the said Sarah Rivington absolutely , subject nevertheless to and charged with the payment of the weekly sum of two shillings and six pence on Saturday in every week clear of all deductions to my Son Joseph Peat during his life the last of such payments to be  made on the first Saturday next after my decease And I empower my said son by distress and also by entry upon and perception of the rents and profits of the said hereditaments so devised to my said daughter Sarah Rivington to recover payment of the said weekly sums then in arrear for fourteen days I devise my dwelling house yard and remaining half of the top Orchard (subject to such right of road as aforesaid and Garden with the appurtenances situate at Mosborough aforesaid now in the occupation of Elizabeth Poole and others to my daughter Susannah Galley absolutely I devise my dwelling house situate and being at Marsh Lane in the said parish of Eckington with the appurtenances together with one half of the garden there situate and now occupied by George Barker, on the West side thereof in a direct line from North to South to my Son William Peat absolutely I devise my other dwelling house situate and being at Marsh Lane aforesaid with the appurtenances and now occupied by the said George Barker or his undertenant together with the other half of the said Garden there situate to my daughter Elizabeth the wife of Glossop Marjerison absolutely I bequeath to my Grandchildren Emma Jean and Annie the two daughters of my late son Jabez Peat deceased the sum of Nineteen guineas each payable at the end of twelve calendar months after my decease I bequeath the sum of Fifty pounds unto and equally to be divided between my said daughter Elizabeth Marjerison and my said Sons Joseph Peat and William Seal their respective Executors administrators and assigns to be payable at the end of twelve calendar months after my decease And as to the residue of my personal estate after payment of my just debts funeral and testamentary expenses. I bequeath the same unto my said daughters Sarah Rivington and Susannah Galley equally to be divided between them share and share alike I appoint my said son James Peat and my Grandson Joseph Rivington Executors of this my Will Lastly I revoke all former Wills In witness whereof I have hereunder set my hand this fourth day of December in the year of our Lord One thousand eight hundred and sixty eight James Peat — Signed by the said Testator as his last Will and Testament, in the presence of us present at the same time  who at his request in his presence and in the presence of each other , have subscribed our names as Witnesses the word Jane in the second page hereof having been first altered to Jean – Alfred Alderson – Robt Fanshaw Junr
