Last Will and Testament of James Cowley of Mosborough, labourer (1837)

This is the last Will and Testament of me James Cowley of Mosbro in the Parish of Eckington in the County of Derby Labourer

First I will and direct that all my just Debts, Funeral expenses and the charges of proving this my Will be paid and payable out of my personal estate and effects by my Executors herein after named Then I give divise and bequeath unto my Wife Kitty Cowley and my son Philip Cowley to hold for life all that messuage dwelling house with the Barn stable and other outbuildings and appurtenances thereto belonging situated in the Town of Mosbro aforesaid and also all that piece of land adjoining thereto containing one acre or thereabouts Also all and singular my Household Goods and Furniture Implements of husbandry Debts rights Credits and effects whatsoever and wheresoever to have and to hold the same for and during the term of each of their natural lives. My Will is they shall not sell or dispose or remove from the aforesaid premises any part of the aforesaid property Goods or Implements, but in case extreme poverty should overtake either my said wife Kitty Cowley or my said Son Philip Cowley during their lifetime. My Will is that my Executors hereinafter named shall raise money on security of the said property either by promisory note or otherwise at their own discretion, to an amount sufficient to keep them and each of them from want and distress, but to no greater amount nor for any other purpose whatever And at the decease of my said Wife Kitty Cowley and my said Son Philip Cowley I will and direct that the aforesaid Messuage or dwelling-house with the Barn stable and outbuildings and appurtenances thereto belonging Also a pew in the South Gallery of Eckington Church all and singular my Household Goods and Furniture Implements of husbandry and effects whatsoever and wheresoever shall be sold, and after paying and discharging thereout the sum of money that may be so raised and levied, upon Note or otherwise as hereinbefore directed and other incidental Debts and expenses, then the residue and remainder of the money arising from the sale of the said property and effects, shall be equally divided amongst my Sons and Daughter James Cowley, Joab Cowley and Sarah Riley or in case of the death of any of the aforesaid Sons or Daughter his or her share must be equally divided amongst his or her children when they are twenty-one years old – I further will and direct that the Household Furniture and Effects whatsoever and wheresoever belonging to my said Daughter Sarah Riley shall not be sold or meddled with but shall be fully left to her at her own disposal – And lastly I do hereby nominate constitute and appoint George Mullins, Farmer and John Ibbotson Hayes, School Master both of Mosbro aforesaid Executors of this my last Will and Testament hereby revoking all former and other wills by me made In Witness whereof I the said James Cowley the Testator have here-unto set my hand and Seal this twenty-first day of November in the year of our Lord one thousand eight hundred and thirty-seven
