This is the last Will and Testament of me George Foster of Mosbrough in the County of Derby Blacksmith made the fifth day of October one thousand eight hundred and seventy eight I bequeath all my household furniture and household effects and all other my personal estate unto my dear wife Eliza absolutely subject to the payment of all my debts (except debts owing by me upon mortgage which mortgage debts I direct shall be payable out of the property upon security whereof the same be owing at my death) and of my funeral and testamentary expenses And I devise my eight brick built dwelling houses situate in Prospect Place in Doncaster in the County of York with their appurtenances subject to and charged with the mortgage debts now charged thereon or so much thereof ( if any ) as shall be unpaid at the time of my death my six condjoining brick built dwelling houses situate at Mosbrough aforesaid with their appurtenances and my three conjoining brick and stone built dwelling houses and shops with their appurtenances situate behind the last mentioned hereditaments at Mosbrough aforesaid and all other my real estate ( if any ) unto my said wife during her life provided she shall so long continue my widow and from and after the decease or marriage again of my said wife whichever event shall first happen I devise my said six brickbuilt dwelling houses and premises situate at Mosbrough aforesaid with their appurtenances ( including the road thereto ) unto my son John during his life and upon his decease unto my son George Foster and John Buxton of Mosbrough aforesaid Miner their heirs and assigns upon trust to sell the same and to divide the proceeds equally amongst all the children of my said son John Foster And I devise my said eight brickbuilt dwelling houses situate in Doncaster aforesaid with their appurtenances ( subject as aforesaid ) and my said three coadjoining brick and stone built dwelling houses and shop situate at Mosbrough aforesaid with their appurtenances including the right of foot and carriage road over the road hereinbefore mentioned ) unto my said son George his heirs and assigns And I devise all the residue ( if any ) of my real estate unto and to the use of my said sons John and George their heirs and assigns in equal shares as tenants in common and not joint tenants I appoint my said wife during her widowhood and my said son George and the said John Buxton to be the Trustees and Executrix and Executors of this my will And I hereby revoke all former wills and declare this to be my last will and Testament In Witness whereof I have hereunto set my hand the day and year above written – George Foster – Signed and declared by the said George Foster the Testator as and for his last Will and Testament in the presence of us present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses Joseph French Carpenter Mosbrough – George Frost Carpenter Mosbrough — — Proved at Derby the fifth day of August, 1884 by the Oaths of Eliza Foster Widow the Relict one of the Executors during widowhood only to whom administration was granted, Power being reserved of making the like Grant to George Foster, the son and John Buxton the other Executors.
