Last Will and Testament of George Cadman of Mosborough, farmer and maltster (1866)

This is the last Will and Testament of me George Cadman of Mosbro in the parish of Eckington in the County of Derby Farmer and Maltster First I will and direct that all my just debts funeral and testamentary expenses be paid and payable out of my real or personal estate and effects by and at the discretion of my Executor and Executrix hereinafter named then I give devise and bequeath unto my Nephew Charles Cadman of Park Mill in the parish of the Eckington aforesaid Corn Miller and Farmer and my Daughter Eleanor Cadman now residing with me all and singular my Lands Tenements and hereditaments Crops and Tillages in the lands I occupy cattle implements monies and Securities for monies and the monies thereby secured household goods and furniture debts rights credits and effects whatsoever and weresoever to have and to hold the same upon trust to be by them disposed of in the following manner and form, that is to say, I give devise and bequeath unto my wife, Ann Cadman the whole thereof for and during the term of her natural life and at her decease I give devise and bequeath the same unto my said daughter Eleanor Cadman subject to the payment thereout of the following legacies, namely, to my Daughter Mary Rose wife of Benjamin Rose of Mosbro aforesaid the sum of Three hundred pounds to be paid to her as follows, that is to say, the sum of Three pounds at the end of every three calender months next after my said wifes decease until the said three hundred pounds is paid her should she so long live but in case of her death before the said Three hundred pounds is fully paid and discharged I will and direct that such balance then due to her at her decease shall be equally divided amongst her children then living share and share alike and paid to them within six calendar months next after her decease to my Daughter Emma Cadman I give devise and bequeath the interest at five percent annum on the sum of three hundred pounds to be paid to her at the end of every three calendar months next after my decease and in case of her decease without issue I will and direct that the said three hundred pounds shall be equally divided between my said two Daughters Mary Rose and Eleanor Cadman share and share alike but in case of issue such issue to take it, And in case my said daughter Eleanor Cadman should die without issue I give and bequeath the whole of her share equally between my said two daughters Mary Rose and Emma Cadman, namely to receive interest and profits arising from such share when and as the same becomes due equally between them the said Mary Rose share to go to her children at her decease and also the said share of my said daughter Emma should she die without issue in such case the whole to be absolutely vested in the children of my said daughter Mary Rose equally alike the rest residue and remainder of my real and personal estate and effects I give devise and bequeath unto my said daughter Eleanor Cadman subject nevertheless to the payment thereout of the said several legacies hereinbefore named which said several legacies shall be raised and levied out of my said real and personal estate and effects by my Executor and Executrix hereinafter named and paid to them when and as the same shall become due and I do hereby nominate constitute and appoint my said Nephew Charles Cadman and my Daughter Eleanor Cadman Executor and Executrix of this my last Will and Testament hereby revoking all former and other Wills by me made In Witness whereof I the said George Cadman the Testator have hereunto set my hand this First day of February in the year of our Lord one thousand eight hundred and sixty six – George Cadman – Signed published and declared by the said George Cadman the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses – John Ibbotson Hayes Mosbro Carolina Ibbotson Hayes Do —  Proved at Derby, the 26th day of April 1876, by the Oaths of Charles Cadman the Nephew and Eleanor Cadman Spinster the daughter, the Executors to whom administration was granted The Testator George Cadman was late of Mosbro in the Parish of Eckington in the County of Derby Maltster and died on the 5th day of April 1868 at Mosbro aforesaid Personal Estate under £450 .
