This is the last Will and Testament of me George Booth the Elder of Mosbro moore Hole in the Parish of Eckington in the County of Derby Yeoman made this twenty third day of November in the year of our Lord Christ One thousand eight hundred and five Whereby I direct that all such debts as I shall justly owe on my decease as also my funeral expenses and the proving of this my said will shall be paid and discharged by my executors hereinafter named And whereas I have sufficiently provided for my son George Booth I do hereby give and devise all and singular my real estate of what tenure nature or kind soever whether in Possession Remainder or Expectancy unto my Son in law William Stockel of Sheffield in the County of York Currier and my friend Benjamin Rose of Sheffield aforesaid Druggist their Heirs and Assigns to the uses upon the Trusts and for the interests and purposes hereinafter mentioned that is to say In Trust that they my said Trustees and the Survivor of them and the Executors or Administrators of such Survivor do and shall receive the rents Issues and Profits thereof until the youngest of my Grandchildren the Children of my son George Booth born of the Body of his late Wife Elizabeth the daughter of John Rose as shall be then living and have attained the age of twenty one years And as for and concerning all those three dwellinghouses with the Gardens and appurtenances as the same are now in the several tenures of Thomas Hattersley Thomas Whiteley and Robert Turner situate in Ridgeway in the Parish of Eckington aforesaid and also all those two closes pieces or parcels of land called the Upper Croft and another Croft in Ridgeway aforesaid containing by estimation two acres and a half And also all that other Close or Parcel of land on Ridgeway moor side containing by estimation two acres as the same three Closes Pieces or Parcels of Land are in the tenure or occupation of my son George his undertenants or assigns with the appurtenances thereunto belonging In Trust that they my said Trustees and the Survivor of them and the Executors or Administrators of such Survivor do and shall convey and assure the same to my Grandson George the son of my said son George Booth when the youngest of my said Grandchildren borne on the Body of the said Elizabeth the late wife of my son George as shall be then living and have attained the age of twenty one years and at and for such price as the same shall be ascertained by a valuation then to be made by an Indifferent Person or Competent Valuer of an Estate of such description To hold to my said Grandson George and his Heirs and Assigns for ever And as for and concerning all other my said Real Estate In Trust that when the youngest of my said Grandchildren borne on the Body of the said Elizabeth the late wife of my said son as shall be then living and shall have attained the age of twenty one years to sell and dispose thereof for the best price and prices that can be reasonably had and obtained for the same And do and shall make and Execute all necessary Deeds Conveyances Surrenders and Assurances for the conveying and assuring of the said Real Estate to a purchaser or purchasers and that the receipt and receipts of my said Trustees or the survivor of them or the Executors or Administrators of such Survivor shall be a good and sufficient discharge and discharges to any Purchaser or Purchasers for so much of the said Purchase money as shall be therein expressed and such Purchaser or Purchasers his her and their respective Heirs Executors Administrators or Assigns shall not afterwards be obliged to see to the application of such Purchase money or be answerable or accountable for any loss misapplication or nonapplication thereof or of any Part thereof respectively, And as for and concerning my Personal Estate of what nature or kind soever as shall remain after answering satisfying and paying my said debts funeral expenses and Probate of this my Will I Give and bequeath the same to the said William Stockel and Benjamin Rose their Executors and Administrators Upon Trust that they my said Trustees and the Survivor of them and the Executors or Administrators of such Survivor do and shall as soon after my decease as conveniently may be sell and dispose of all such Parts of the residue of my said Personal Estate (as shall not consist of Money Securities for money and debts owing to me) for the most money and best price and prices that can be reasonably had or gotten for the same And also collect get in and receive all such debts Securities for Money due and owing to me on my decease And do and shall out of the monies arising therefrom pay to my daughter Sarah the widow of John Booth deceased the sum of five hundred pounds at the expiration of twelve months after my decease And do and shall invest the surplus of the monies that shall arise by such sale and disposal of my Personal Estate and as shall be collected and received as aforesaid together with such part of my ready money if any as shall remain after answering the purposes aforesaid and the Payment of the said sum to my said daughter upon Government or Real Securities at Interest And in like manner invest all sum and sums of money as shall from time to time arise and be received from the rents issues and profits of my real estate and the Dividends and Interest of my Personal Estate And which said Securities shall and may from time to time be altered varied transferred assigned and the monies arising therefrom be again invested upon other Government or real securities as to them the said William Stockel and Benjamin Rose or the Survivor of them or the Executors or Administrators of such Survivor shall think proper All which monies and securities for money and also all the monies that shall arise from the sale and sales of my said Real Estate Upon the Trusts and for the interests and purposes hereinafter mentioned expressed and declared of and concerning the same that is to say Upon Trust that they my said Trustees and Survivor of them and the Executors and Administrators of such Survivor shall and may claim all such sum and sums of money damages costs charges and expenses which they or any of them respectively shall bear Pay sustain expend or be put into in and about the Executing of the several Trusts in this my Will contained And also In Trust to pay my Grandson George Booth borne on the Body of the said Elizabeth the late wife of by said son George the Sum of One hundred Pounds when he attains the age of twenty one years And also do and shall when the youngest of said Grand Children borne on the Body of Elizabeth the late wife of my son George as shall be living and shall have attained the age of twenty one years pay to my Grandchildren the children of my said daughter Sarah the widow of the said John Booth the sum of five hundred pounds in equal shares and proportions that such of them as shall be then dead leaving lawful child or children such child or children to have and receive such part and share as their respective parent would have been entitled to if living and if more than one to such children equally amongst them and if but one child then the whole to such one Child And after the several payments made and received as hereinbefore directed In Trust to pay and apply the residue and remainder of all Sum and Sums of Money arising from my real and Personal Estate and the dividends Interest and Produce thereof and of every part thereof when the youngest of my said Grandchildren borne of the Body of the said Elizabeth the late wife of my Son George as shall be then living and shall have attained the said age of twenty one years to and amongst my said Grand Children George James John and Elizabeth in equal parts shares and proportions and such of them my said Grandchildren the said George James John and Elizabeth as shall attain their respective ages of twenty one years such part or share as such child would become entitled to at the time aforesaid shall become and be vested in such child and children and such of them my said Grandchildren the said George James John and Elizabeth as shall depart this life before attaining of the age of twenty one years leaving lawful child or Children then and in such case In Trust to pay such Child and Children such part or share as their respective parents would have been entitled to if then living if more than one Child equally amongst them and if one child only to pay the whole to such one Child And I do hereby nominate and appoint the said William Stockel and Benjamin Rose Executors of this my last Will and Testament hereby revoking all other wills by me heretofore made In Witness whereof I the said George Booth the Elder the Testator have to this my last Will and Testament contained in this and the two preceding sheets of paper set my hand and seal that is to say my hand to the preceding sheets and my hand and seal to this third and last sheet the day and year first above written.
