Last Will and Testament of Eliza Slagg of Mosborough (1836)

This is the last Will and Testament of me Eliza Slagg the Wife of Harvey Slagg of Mosbro in the County of Derby Maltster I give and bequeath unto my half Sisters Elizabeth Jervis and Ann Woodhouse the sum of Ten Pounds each to be paid to them within twelve calendar Months next after my decease And as to all and singular the Sum of Money consisting the Sum of Fifteen hundred pounds which the Trustees named and appointed in the Settlement made previous to my marriage are directed to levy and raise on a certain Freehold Estate situate at Crow Lane in the Parish of Ounstone in the said County of Derby for the equal benefit of my Children or otherwise as I may think proper in my last Will and Testament to direct or appoint and as to all and singular the rest residue and remainder of my personal Estate property and Effects I do hereby declare my Will and mind to be that the Trustees hereinafter mentioned and the survivor of them and the Executors Adminstrators and Assigns of such survivor shall stand and be possessed of and interested in the same trust monies and the Interest dividends and annual produce thereof In Trust to lay out and invest the same in their or his names or name on government or real Security or otherwise appropriate and invest to the best advantage and pay the interest dividends and annual produce thereof unto my said Husband for and during the term of his natural life and from and immediately after the decease of my said Husband then I will and direct that all and singular the said trust monies funds and securities shall go to and be divided in equal shares between and amongst all and every my present and future born Children and Child who may be living at the time of the decease of my said Husband and the Issue of such of my said Children lawfully begotten as may be then dead if more than one in equal shares and proportions and if there shall be but one such Child then to such one and only child but such Issue shall receive the share or shares only to which their Parent would if living have been entitled And in case all of my said Children shall die during the lifetime of my said Husband without leaving lawful Issue or such Issue shall happen to die before attaining the age of twenty one years then I give and bequeath all and singular the said trust monies funds and securities and the accumulation thereof if any unto my said Husband his Heirs Executors Administrators and Assigns for his absolute use and benefit. I do hereby appoint my Friends Mr Joseph Slagg and Mr Thomas Denton along with my said Husband Trustees and Executors of this my Will and I do hereby declare that my said Trustees shall not be accountable the one for the other of them but each for himself only nor for involuntary losses and I do hereby revoke and make void all former Wills by me at any time heretofore made and do declare this only to be my last Will and Testament In Witness whereof I the said Eliza Slagg the Testatrix have to this my last Will and Testament contained in one sheet of paper set my hand and seal this ninth day of January in the year of our Lord one thousand and eight hundred and thirty six
